NEW DELHI: Pent up frustration over judges being systematically targeted for their decisions boiled over on Friday with Chief Justice of India N V Ramana making a poignant observation that “even the governments have joined others in maligning judges”.
The remark came from the CJI, who was heading a bench also comprising Justices Krishna Murari and Hima Kohli, while dealing with an appeal filed by Chhattisgarh government challenging a HC order quashing the disproportionate assets case registered by present Congress government against former BJP chief minister Raman Singh’s close aide Aman Singh and his wife.
At a time when judiciary bashing has become a favourite pastime of activists whenever the decisions did not meet with their approval, the CJI’s frustration had a background. In the Karnataka mining case on Thursday, Karnataka government counsel Dushyant Dave had unleashed “fireworks”, as described by Justice Vineet Saran-headed bench to solicitor general Tushar Mehta. Mehta had attempted to assuage the hurt feelings of the SC judge by saying that Dave had a habit of saying things inside the courtroom.
However, it seems the ‘fireworks’ inside Saran’s courtroom was the talking point among the SC judges and they felt that a counsel representing the government should exercise some deference to the highest court and its judges.
Finding the Chhattisgarh government’s appeal making unwarranted comments against the HC judge, who by an order of January 10 had quashed the FIR against Aman Singh, the CJI took strong exception and said, “it has become a norm for everyone to attempt maligning the judges. Now even the governments have joined.”
Appearing for the Bhupesh Baghel government, senior advocate Rakesh Dwivedi said he would not press the remarks made in the appeal against the judges. But, he said that the officer, when he joined service in 2004 had assets worth Rs 11 lakh, but now has properties worth Rs 2.7 crore.
