NEW DELHI: The Supreme Court on Tuesday told the Centre that Baba Ramdev and his ayurveda venture Patanajali must be restrained from making false claims about curing incurable diseases and publishing ads disparaging the allopathy system of medicine and doctors. “Ramdev should not criticise other medicine systems and accuse allopathic doctors as killers. This is impermissible,” the SC said.
Appearing for petitioner Indian Medical Association, advocate Prabhas Bajaj presented a chain of ads issued by Patanjali making false claims about finding cure for Covid-19, high BP and asthma, which is punishable.
Pulling up Baba Ramdev for making “false claims” and accusations that allopathy is wreaking havoc on patients, a Supreme Court bench comprising Chief Justice N V Ramana and Justices Hima Kohli and CT Ravikumar said, “What has happened to Baba Ramdev? Why should he level accusations against every other system of medicine? We respect him for popularising yoga. But he should not criticise other medicine systems. This is impermissible. It is better that the Centre restrains him from making such false claims and from deriding other medicine systems.”
Appearing for petitioner Indian Medical Association, advocate Prabhas Bajaj told the court that while Patanjali as a commercial entity is entitled to sell its products, it should not be permitted to make such false claims. The SC sought responses from the Union ministries of ayush and health, Patanjali Ayurveda Ltd, Advertising Standards Council of India and Central Consumer Protection Authority as the petitioner IMA alleged that the authorities, despite being aware that these claims and advertisements were contrary to the laws of land, have not taken any remedial measures.
IMA accused Ramdev and Patanjali of “making false claims and imputations seeking to disparage allopathy and the modern system of medicine, and misguide and mislead the common man” by claiming to have found a cure for high BP, diabetes, thyroid, glaucoma, fatty liver, liver cirrhosis, skin diseases , arthritis, cervical, spondylitis, asthma, etc, saying this is punishable by law.
IMA said while Patanjali had a right to promote its own products, its unabated spread of misinformation regarding allopathy and the modern system of medicine as well as false claims to cure incurable diseases is continuing with complete inaction and indifference from the authorities.
